This Agreement applies to the use of the “Ultifresh” website and services, including all orders placed or processed for products or services related to the website and services. You, and Ultifresh Activewear Pte Ltd/ Ultifresh Activewear Sdn Bhd, a t-shirt manufacturer providing wholesale apparel, on-demand apparel printing, merchandising and another related service on clothes, are the parties to this Agreement. If you choose to use other features of the Site and Services, additional terms may apply. No exceptions to these terms will be valid unless agreed in writing by Ultifresh. Ultifresh may change these terms from time to time. If Ultifresh makes changes to these terms, you will be required to accept the new terms as a condition to continued use of Ultifresh website and services. If you do not agree to any modifications, you must stop using Ultifresh website and services.

Disclaimer

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. Due to normal changes in our industry and our technical production processes, Ultifresh may reasonably deviate from descriptions and information about materials, colours, weights, dimensions, designs or other characteristics in its catalogues and other documents.

Force Majeure

Neither party shall be liable to the other for any failure to perform any of its obligations under any agreement due to events beyond the control of the party (including, but not limited to, any act of God, political insurrection, uprising, riots), civil unrest, civil or military authorities Acts, uprisings, earthquakes, floods or any other natural or man-made event beyond our control which results in the termination of the agreement or contract entered into, nor reasonably foreseeable. Either party affected by such an event shall immediately notify the other party and shall use all reasonable endeavours to comply with the terms and conditions of any agreement contained herein.

Privacy Statement

Ultifresh is committed to protecting your privacy. Authorized employees within the company use only any information collected from individual customers on a need-to-know basis. We continually review our systems and data to ensure the best possible service to our clients. Ultifresh will not sell, share or rent your personal information to any third party, nor will we use your email address for unsolicited mailings. Any emails sent by the company are only related to the provision of the agreed services and products. If the information is incomplete or incorrect, you have the right to request that the information be corrected or deleted. Payment

All major Credit/Debit Cards, FPX Banking, GrabPay and PayPal are the only acceptable methods of payment. Regarding the latest update on Ultifresh website payment, customers from Malaysia can only choose to pay via Credit/Debit Cards, FPX Banking, GrabPay while customers from Singapore will be automatically navigated to the PayPal payment method. Our terms are full payment must be completed before delivery of goods. All merchandise is the property of Ultifresh until full payment. Ultifresh reserves the right to limit the method of payment chosen by the customer depending on order value, shipment destination or other objective criteria.

Refunds Policy

Only out-of-stock items, wrong products and damaged couriers can be refunded. Any claims for damages must be made in writing to us within 2 working days upon receiving our goods. Send an email to hello@ultifresh.net and indicate the issues with supporting proof such as photos or videos. Ultifresh team will investigate and respond within 24 hours, excluding holidays and non-working hours. Any payment to Ultifresh constitutes payment for the provision of unused services and will be refunded. If the refund request is approved, customers are required to send back the item to Ultifresh’s office and the purchase price will be refunded to the customer using the original payment method.

Delivery & Shipment

Ultifresh guarantees that the order will be processed within 2 days of receipt except for holidays and non-working hours. After packaging, a delivery service will be arranged. Usually, customers will receive the item within 2 weeks. If the parcel is damaged, the customer can reject to sign for the parcel. Ultifresh will use the shipping service provider of its choice for delivery. Customers must pay standard shipping charges which may depend on the order value and shipping destination. Shipping costs will be shown on the checkout page.

These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
